A settlement has been reached in a class action lawsuit against Fujifilm Diosynth Biotechnologies U.S.A., Inc. (“Defendant”) involving a Data Incident that took place in the summer of 2025, involving Defendant and resulting in the potential unauthorized access to or acquisition of Settlement Class members’ Private Information. The Private Information involved includes information related to Defendant’s current and former employees, including, but not limited to, name, Social Security number, date of birth, driver’s license information, passport number, retirement account information and medical information.

The Settlement Class includes: all individuals residing in the United States whose Private Information was impacted by the Data Incident affecting Fujifilm that Fujifilm discovered in approximately September 2025, including all those who received notice of the Data Incident. If you are a member of the Settlement Class, you can submit a Claim Form for the following Settlement Class Member Benefits:

All Class Members are eligible to enroll in Credit Monitoring and one of the two Cash Payment options. These benefits are described in more detail below.

Credit Monitoring. All Settlement Class Members will receive two (2) years of free Credit Monitoring Services from CyEx Identify Defense Complete. Enrollment instructions will be available after the Court grants final approval.

Out-of-Pocket Losses. Settlement Class Members may submit a Claim Form with reasonable documentation for losses related to the Data Incident for up to $2,500.00 per Settlement Class Member (subject to a pro rata adjustment based upon the total value of all Valid Claims). Eligible losses include those incurred on or after September 4, 2025, through the Claim Deadline and include (without limitation):

  • bank fees;

  • long distance phone charges, cell phone charges (only charged by the minute);

  • data charges (only if charged based on the amount of data used);

  • postage;

  • gasoline for local travel; and

  • fees for credit reports, credit monitoring, or other identity theft insurance products purchased.

Alternative Cash Payment. Instead of claiming for Out-of-Pocket Losses, Settlement Class Members may submit a Claim Form to receive an alternate cash payment in the amount of $50.00.

Get no Settlement Class Member Benefits. Keep your right to file your own lawsuit against the Released Parties about the Released Claims that are released by the Settlement in this lawsuit.

Object to the Settlement

Stay in the Settlement, but tell the Court why you do not agree with the Settlement. You will still be bound by the Settlement if the Court approves it.
